Study on ‘Update the Unfair Contract Terms Directive for Digital Services’

The European Commission has awarded Altair the study on ‘Update the Unfair contract terms directive for digital services’. The scope of the study is to analyse how digital service providers use standard terms and conditions in consumer contracts that could be unfair, both in regard to the contract itself (e.g. several Facebook conditions have been found unfair by German courts) and in regard to the consent clauses/data protection terms that users are required to accept (for instance, Facebook clauses have been declared unfair and void). So, the study should look into how European legislation needs to be updated to address unfair contract terms and consent clauses for digital services.
